The BART board of directors rejected a tentative contract agreed upon by their own in-house negotiators and outside consultant Thomas P. Hock who is a vice president of Veloia Transportation company. This meeting took place on November 21, 2013. The Board voted on an agreement that did not include FMLA or family leave saying it cost too much. SEIU 1021 consultant and chief negotiator Josie Mooney admitted that the union leadership and negotiating committees had made major concessions. Workers were sent sent back to work twice without a vote of the rank and file of either ATU 1555 and SEIU 1021. The unprecedented rejection of a tentative agreement angered the rank and file of SEIU 1021 and ATU 1555 who thought they had a contract and may lead in the future to workers staying on strike until they get a written contract agreement.
